Simon, I think we end up in the same place, albeit coming from slightly different directions. I am 100% with you on "it depends" - yes and we can use the argument that in your example, someone else's activity affords us (hillwalkers) access into those hills - although it is kinda the same argument, that because of the civil war in Syria we are now good best friends with Iran ....
The only divergence I think is where your concern is about noise - and mine is about getting shot.
In Scotland, when they are culling or stalking the Red Deer, hillwalkers are not permitted on the hill and trundle off quite happily to somewhere, where they are.
Interestingly - or not - in Scotland there is no law of trespass, so you would think there would be more confusion about access rights - but there is not.
There is no deterrent to trespass other than a couple of Purdeys pointing straight at you. A good deterrent in my view.
